2. Terms of Access and Use

Accessing and using TestaDigi confers user status and implies full acceptance of all terms herein, as well as our Terms of Service, Privacy Policy, and Cookie Policy.

Using the platform for illegal purposes, violating third-party rights, or attempting to compromise system integrity is strictly prohibited.

3. Intellectual and Industrial Property

All website content, software code, graphic designs, logos, and service architectures are the exclusive property of TestaDigi or authorized licensors and are protected under international copyright laws.

4. Disclaimer and Limitation of Liability

While TestaDigi applies robust state-of-the-art security practices under Article 32 GDPR to ensure uptime and data privacy, TestaDigi shall not be held liable for:

• Service disruptions caused by third-party telecommunication failures, force majeure, or global Internet downtime.
• Loss of access resulting from user negligence in safeguarding their login master passwords.
• The accuracy, truthfulness, or legality of private content entered by users in encrypted messages, which TestaDigi does not inspect due to its Zero-Knowledge architecture.

5. Applicable Law, Jurisdiction, and Consumer Venue

These terms are governed by Spanish and European Union law. Where the user acts as a consumer under Article 90.2 of Royal Legislative Decree 1/2007 (TRLGDCU) and Article 18 of Regulation (EU) 1215/2012, the competent courts shall be those of the consumer's place of domicile. In all other business-to-business cases, the parties submit to the Courts of Badalona / Barcelona (Spain).
