1. Purpose of the Service
TestaDigi offers a tool for sending scheduled emails conditioned to the user's inactivity. The service is designed as a form of digital legacy.
2. Proper Use
The user agrees not to use the platform to send spam, illegal, threatening, defamatory content or content that infringes the rights of third parties. Testadigi.com reserves the right to block users who do not make proper use of the application.
3. Service Availability
TestaDigi does not guarantee that the service will be uninterrupted or error-free. We are not responsible for damages arising from technical failures in sending emails.
4. Accounts and Subscriptions
Free accounts have functional limitations and advertising. Pro/Premium subscriptions allow additional functionalities and are non-refundable once the corresponding period has been billed.
5. Exemption of Legal Validity
TestaDigi is a deferred communication tool and does not replace a notarized will or official document. The platform has no formal legal validity as a will in most jurisdictions.
6. Intellectual Property
The design, code, and logo of TestaDigi are the exclusive property of the company. However, users retain 100% of the intellectual property and copyrights over the content of the messages and files they upload to the platform.
7. Force Majeure
TestaDigi is exempt from any liability for failure to deliver messages or loss of data caused by catastrophic events, natural disasters, cyber attacks, or massive failures in network infrastructure providers (force majeure).
8. Modification of Terms
We reserve the right to modify these terms and conditions at any time. Continued use of the platform following the posting of changes constitutes express acceptance of those changes.
Misuse, Prohibited Conduct, and Account Termination for Bad Faith
It is strictly prohibited to use TestaDigi for illegal activities, bad faith conduct, or actions contrary to public order, including harassment, cyberbullying, insults, defamation, threats, or sending abusive content to third parties. If misuse or malicious activity is detected or reported, TestaDigi reserves the right to immediately and permanently suspend, cancel, and disable the responsible user's account without prior notice. Such termination will result in the automatic and irreversible forfeiture of any remaining PRO or Premium subscription period, with no right to a refund, monetary reimbursement, or compensation of any kind.
